Pension fraud charges against former director dismissed

Criminal proceedings against former company director, Nicholas Marks, have been dismissed after it was confirmed that he had passed away.

Marks previously denied defrauding his workers’ pensions last year, after being charged with one count of fraud by abuse of position in respect of employees of social enterprise Clarity Products Ltd, and a further such count in respect of employees of Lunar Automotive Ltd.

Marks was due to stand trial on 18 May 2026 at Southwark Crown Court. However, the criminal proceedings were dismissed at a hearing today (19 March) at Southwark Crown Court after it was confirmed that he had recently died.

The Pensions Regulator (TPR) said that it recognises the impact on the victims affected and has notified them accordingly.
